In my previous article “DSA and Allegro – New Rights for Sellers”, I discussed how the EU’s Digital Services Act (DSA) is changing the way platforms like Allegro operate. Today, I want to return to that topic from a much more practical perspective—by sharing the real-life story of a client whom I helped recover a blocked Allegro seller account.
This time, it’s not just about regulations on paper, but about what the fight for access to a seller account actually looks like in practice—and how, despite significant obstacles, legal action can lead to very real results.
📉 Suspension of an Allegro Seller Account – A Sudden Problem with Serious Consequences
My client, the owner of an electronics trading business, had been selling through Allegro for quite some time. At a certain point, his account was suddenly suspended—without any prior warning. Allegro stated that the decision was based on Article 2.12 of its Terms & Conditions, which provides that:
“If a User’s Account or activity on Allegro requires additional verification (…), or if the Company has justified concerns regarding the security of the Account or Transactions (…), the Company may:
a) make the use of Allegro conditional upon the User confirming their credibility with appropriate documents (…),
b) temporarily restrict access to certain services (…),
c) suspend the User’s Account for a fixed or indefinite period (…).”
In practice, this meant one thing: my client lost access to his account and the ability to sell. His revenue dropped to zero, and Allegro—despite receiving the requested documents—refused to restore access to the account.
📁 Attempts to Explain the Situation – Without Success
The suspension occurred after a sudden surge in sales, which Allegro interpreted as giving rise to “justified concerns regarding account security.” The client tried to clarify the situation by submitting, among other things:
a copy of his ID,
contracts and documentation related to his dropshipping business model,
a detailed explanation of the situation.
He complied with all of Allegro’s requests, including completing or cancelling all pending orders—which was particularly difficult given that Allegro had blocked the funds from completed sales.
Despite these efforts, Allegro maintained its position and suspended the account indefinitely. To make matters worse, Allegro stated that the decision was final and would not be reconsidered.
⚖️ My Intervention as a Legal Counsel
At this point, the client realized that continuing the dispute with the platform on his own would be ineffective and that he needed professional legal assistance.
He contacted me, and I took on the case as his legal representative. In particular, I:
formally informed Allegro that the client was represented by a lawyer and requested clarification of the situation,
analyzed the case from a legal perspective and prepared a formal demand for the restoration of access to the account,
raised arguments based both on Allegro’s own Terms & Conditions and on EU law—specifically the Digital Services Act (DSA), which imposes obligations on digital platforms regarding transparency, justification of account restrictions, and access to effective appeal mechanisms.
🧱 Resistance from Allegro
In response, I received a reply from Allegro’s legal department maintaining its previous position—the account would not be reinstated. However, I did not intend to give up. In further correspondence, I:
pointed out specific violations of the DSA that had occurred during the handling of the case,
informed Allegro of potential further legal steps should the suspension continue,
renewed the formal demand for restoration of access to the account.
🔓 The Breakthrough – Allegro Changes Its Position
These actions proved effective. Allegro’s legal department informed me that reinstating access to the platform was possible and requested contact to agree on the conditions for lifting the suspension.
This was the first clear signal that Allegro was seriously considering restoring the account. From that point on, the case progressed quickly. Within just a few days, the client received the long-awaited message:
“Your Allegro account is active again and you can use it.”
🧠 What Can We Learn from This?
This case clearly shows that the suspension of an Allegro account is not always justified. Although Article 2.12 of the Terms & Conditions grants the platform broad discretion, users are entitled to transparency and proportionality in enforcement actions. Under the DSA, this is no longer merely a matter of good practice—it is a legal obligation.
